Thailand does not have a specific work visa type. It is possible to get a work permit issued on a variety of non-immigrant visas, like - business, marriage, Thailand elite card visa etc.
It is not possible to obtain a work permit if you are holding a tourist visa or a visa on arrival. However, it might be possible to convert a tourist visa to a non-immigrant visa within Thailand. Student visa holders cannot obtain a work permit as well. The most common visa held by foreign workers in Thailand is the non-immigrant B visa.
As per Thai law, Indian passport holders can apply for a Thai visa only in India or a country they are resident in. Typically, the Thai embassy and consulates in India issue only a single entry non-immigrant B visa which entitles you to stay in Thailand for 90 days. They also usually insist on looking at a pre-approved work permit or WP 3 before issuing the visa. In order to obtain the WP 3 certificate, your Thai visa sponsor would have to approach the Department of Labor in Thailand.
A one year extension of the B visa can be obtained in Thailand after the foreign worker obtains a work permit and if the sponsor company meets certain conditions stipulated by the immigrant department.
Typical Thailand Visa and Work Permit process:
1. Thai Visa sponsor company applies for WP 3/pre-approved work permit in Thailand.
2. WP 3 is issued by the Department of Labor . The same is mailed to the visa applicant along with other relevant documentation by the Thai company.
3. The visa applicant approaches the VFS centers or Thai consulates in India and applies for a non-immigrant B visa.
4. A single entry non-immigrant visa is issued by the Thai embassy in India.
5. The foreign worker enters Thailand and applies for and obtains a work permit.
6. The foreign worker approaches Immigration department and obtains a one year visa extension. Typically, a multiple re-entry permit is also obtained as it allows the worker to enter/exit Thailand freely during the validity of the visa.
